Welcome to First Social CasNZ Ltd. These Terms & Conditions ("Terms") govern your access to and use of our website, games, services, and applications (collectively, the "Services"). 1. Acceptance of Terms

2. User Accounts

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify First Social CasNZ Ltd. immediately of any unauthorized use of your account or any other breach of security. First Social CasNZ Ltd. will not be liable for any loss or damage arising from your failure to comply with this section.

3. Virtual Currency & In-Game Items

Our Services may include virtual currency ("Coins") and virtual in-game items or goods ("Items") that can be earned through gameplay or purchased. Coins and Items have no real-world monetary value and cannot be redeemed for real currency, goods, or other items of monetary value from First Social CasNZ Ltd. or any other party. They are solely for use within our Services. All purchases of Coins and Items are final and non-refundable. First Social CasNZ Ltd. retains the right to manage, regulate, control, modify, or eliminate Coins and Items at its sole discretion, and shall have no liability to you or anyone else for the exercise of such rights. You acknowledge that you do not own the Coins or Items but are granted a limited, revocable, non-transferable license to use them within the Services.

4. User Conduct

You agree not to engage in any prohibited activities, including but not limited to:

  • Violating any laws or regulations.
  • Infringing upon our intellectual property rights or the rights of others.
  • Harassing, abusing, or harming other users.
  • Using automated scripts, bots, or other means to access or interact with the Services.
  • Attempting to interfere with the proper working of the Services.
  • Distributing viruses or other harmful computer code.
  • Engaging in any form of cheating, hacking, or exploiting glitches.
  • Selling, trading, or transferring your account or any virtual currency/items outside of the Services.

Any violation of these conduct rules may result in immediate suspension or termination of your account and access to the Services, without refund, and may subject you to legal action.

All content, features, and functionality on the Services, including but not limited to text, graphics, logos, images, software, and the compilation thereof, are the exclusive property of First Social CasNZ Ltd. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FIRST SOCIAL CASNZ LTD. SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. FIRST SOCIAL CASNZ LTD. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

7. Limitation of Liability

IN NO EVENT SHALL FIRST SOCIAL CASNZ LTD., ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

8. Indemnification

You agree to defend, indemnify, and hold harmless First Social CasNZ Ltd. and its licensees and licensors, and their employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Services.

9. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Wellington, New Zealand.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have had between us regarding the Services.
